Vijay Panchal, director of M/s Yashraj Corporation and developer of the Shivchandra SRA Co-operative Housing Society project in Mulund, has sought anticipatory bail before the Mumbai Sessions Court after an FIR alleged he handed over flats without an Occupation Certificate, failed to transfer Project Affected Persons (PAP) flats to the Slum Rehabilitation Authority, and allowed unauthorised occupation of the building. The FIR states the developer was issued notices under Sections 53(1) and 53(6)(b) of the MRTP Act on 1 April 2026 and 4 May 2026 directing compliance; investigators allege the violations continued despite these notices. Under the Slum Rehabilitation Authority framework, a developer typically earns additional saleable FSI in exchange for constructing free rehabilitation flats for Project Affected Persons and transferring them to the SRA's control. Failure to complete this transfer is treated as a serious breach of the scheme's core exchange, distinct from ordinary construction delay. An anticipatory bail application seeks protection from arrest in the event of arrest, and is decided on considerations such as flight risk and likelihood of tampering with evidence. It does not require the court to first determine guilt or innocence, and its grant or refusal carries no finding on the merits of the underlying allegations.
